The 37-year-old Westminster resident is scheduled to be arraigned today on one felony count of murder with sentencing enhancements for personal discharge of a firearm causing death, three sentencing enhancements for crime-bail-crime, prior felony convictions for residential burglary in 1996, possession of a firearm by a felon in 2002, possession of a firearm by a felon in 2008, and possession of a controlled substance with intent to sell in 2010.
If convicted, he faces up to 85 years to life in state prison, according to the OCDA.
Duvall was out on bail for three separate open cases Sunday evening, when he attended a birthday party for Tina Pauline Arbogast (happy 48th!) in her Westminster home where 15 to 20 people had gathered. Around 10 p.m., Duvall got into such a heated argument with his 56-year-old uncle Frank Duvall that the nephew whipped out a loaded firearm, according to OCDA.
Daniel Duvall allegedly followed his uncle out of the party and, as Frank tried to leave in his van, he was shot once in the torso and later died.
“Immediately after the shooting, Arbogast is accused of approaching Daniel Duvall and asking for the firearm,” reads an OCDA statement. “Arbogast is accused of taking the firearm and then fleeing the scene in her own vehicle. Daniel Duvall is accused of fleeing the scene shortly thereafter on his motorcycle. The defendants are accused of fleeing to Riverside County.”
There, in Canyon Lake, is where Westminster police officers arrested the pair Tuesday afternoon.
Arbogast, who is charged with one felony count of accessory after the fact and faces up to three years in state prison with a conviction, is scheduled to be arraigned with Daniel Duvall in Westminster this afternoon.

UPDATE NO. 1, MARCH 12, 10:03 A.M.: A man who was related to Westminster's Frank Duvall, who was found dead in a car in that city Sunday night, has been arrested on suspicion of killing the 56-year-old. And 45-year-old Tina Arbogast, who like 37-year-old Daniel Duvall resides in Westminster, is being held as an accessory in the killing.
The pair were arrested without incident around 3:30 p.m. Wednesday in a home in the 22000 block of Blue Bird Drive in Canyon Lake, an affluent gated community in Riverside County, according to Westminster Police. Cops have not yet said how Daniel and Frank Duvall are related nor Arbogast's relationship to either one of them. An autopsy is pending to determine cause of death.
ORIGINAL POST, MARCH 10, 10:51 A.M.: A 56-year-old man who was found dead in a vehicle in Westminster Sunday night from an apparent homicide has been identified by the county coroner as Frank Duvall of Westminster.
His body was found in a parked vehicle near the intersection of Topaz Street and Sapphire Avenue around 10:15 p.m. Sunday, according to Westminster Police Officer Alan Aoki, who added the victim showed unspecified signs of trauma.
An autopsy will take place later this week, the coroner's office says.
